1. Who We Serve

RocketSurvey is a survey creation and response platform built for professionals, businesses, institutions, and organizations. The Services are not intended for personal, family, or household use. By using the Services on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

RocketSurvey only provides Services to users located in Canada and the United States.

2. Your Account

• You must create an account to access most Services.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information.
• You are responsible for all activity under your account.

3. Fees and Billing

• Certain Services are offered on a paid subscription basis.
• Fees are billed in advance and are non-refundable except as required by law.
• Subscriptions will automatically renew unless you cancel before the end of the billing cycle.
• You are responsible for any applicable taxes.

4. Use of Services

You agree not to use the Services:

• For any unlawful, harmful, or abusive purpose;
• To collect sensitive personal information, including credit card data, unless explicitly permitted;

7. Security

We maintain reasonable administrative, technical, and physical safeguards to protect your data. However, no system is completely secure. You are responsible for maintaining backups of Your Content.

8. Termination and Cancellation

• You may cancel your account or subscription at any time through your account settings.
• We reserve the right to suspend or terminate your account for violations of these Terms or misuse of the Services.
• Inactive free accounts may be deleted after 12 months of inactivity.

9. Disclaimers

The Services are provided "as is" without warranties of any kind. We do not guarantee that the Services will always be available, error-free, or meet your specific needs.

10. Limitation of Liability

To the extent permitted by law, RocketSurvey shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you to RocketSurvey in the 12 months prior to the event giving rise to the claim, or CAD/USD $200—whichever is less.

11. Indemnity

You agree to indemnify and hold harmless RocketSurvey and its officers, directors, employees, and affiliates from any claims or damages arising from Your Content, your use of the Services, or your violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes. Continued use of the Services after changes become effective constitutes your agreement to the new Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Newfoundland & Labrador, Canada or the United States, without regard to conflict of law principles.
